Except for any rights of third parties, the entire content of the App, including software, images, graphics, photographs, drawings, texts or any other copyrighted work provided, is the intellectual property of CogniSensus and is protected according to the relevant provisions of Greek law, European law, and international conventions.

By downloading and installing the App the Users do not acquire any right to modify, adapt, alter, translate, re-arrange or distort the App’s software in any manner or form. Any act of decompiling or reverse-engineering of the source code of the App’s software is expressly prohibited, unless it is expressly allowed by the applicable national legislation for the purposes and under the limitations that such legislation provides. Any reproduction, sale, lease, rental, distribution, public presentation or digital dissemination including the communication to the public of the whole or a part of the App’s software through analog or digital means and for the purposes of commercial exploitation of the software in question or a work or product generated by said software, is expressly prohibited.

Any copying, distribution, sale, arrangement, adaptation, alteration or creation of derivative works of the App content is prohibited. Any reproduction, public presentation, uploading and  communication to the public of the App and its Content by any means for commercial or other purposes, especially advertisement, is permitted only with the prior written permission of CogniSensus or any other copyright holder. The names, images, logos, and distinctive features mentioned in the App are exclusive trademarks of CogniSensus or third parties protected by the relevant trademark legislation. Their appearance on the App does not constitute a transfer of the absolute and exclusive property rights of CogniSensus or any other right holder or an assignment of a license to use them.

Publication includes the act of making the protected software and content available to the public by electronic means of all kind including the social media. Distribution means the dissemination of the material support incorporating the protected software and Content. Communication to the public means any act of dissemination of the protected software and Content through the internet in any manner or form including acts of making available to the public in such a way that members of the public may have access from a place and at a time individually chosen by them.

CogniSensus, via its website and/or the App and/or by any other appropriate means at its discretion, shall inform the users of the App about any developments concerning the App, such as the introduction of new digital content, changes in the way of access, modification of the present terms of connection to its network, change of the price list or the billing method, etc.

CogniSensus shall take all reasonable measures so that the data, information, and audiovisual material that constitute the content of the App are complete, accurate and reliable based on peer-reviewed and reliable sources. However, CogniSensus does not guarantee the correctness, completeness, accuracy, and reliability of the aforementioned data and is not liable to the Users or third parties for any damages due to the data’s incorrect, inaccurate, or inadequate nature.

CogniSensus makes every reasonable effort for the proper functioning of the App but does not guarantee that the App functions will be uninterrupted or that the App will be free of any kind of error or security vulnerabilities.

In view of all the above, Users accept that CogniSensus is entitled to modify and/or temporarily or permanently suspend without prior notice all or part of the App functionalities in order to improve its operation, behavior and security.

Your privacy is important to us. By using the App, you consent to the collection, use, and sharing of your information as outlined in our Privacy Policy.

Users may use the App only for lawful purposes and in accordance with these Terms. Users may be liable for any damage caused to CogniSensus due to their improper or unfair use of the App and the services offered with it.

CogniSensus is entitled at any time and without prior notice to revoke the right of a particular User to use the App, in case CogniSensus becomes aware or reasonably suspects that this User has violated these Terms.

To use certain features of the App, you must register by providing your email address, creating a username, and setting a password. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality of your account credentials.
• Notify us immediately of any unauthorized use of your account.

CogniSensus is entitled at any time and without prior notice to suspend or terminate a particular User’s account, in case CogniSensus becomes aware or reasonably suspects that this User has violated these Terms.

The App allows users to scan real-life physical objects for augmented reality visualizations. You acknowledge and agree that:

• The AR content may be subject to variations depending on your location, environment, and device capabilities.
• You are solely responsible for your actions while using the App, including maintaining adequate awareness of your surroundings at all times.
• You will not use the App in a way that poses a risk to your safety or the safety of others (e.g., while driving or in dangerous locations).

CogniSensus is not responsible for any injuries, damages, or losses resulting from your use of the AR features.

The App requires access to your camera and location to provide AR content and location-specific features. You consent to the App accessing and using these features. You can manage or disable permissions through your device settings, but this may limit the functionality of the App.

The App may allow you to upload photos, answer quizzes, and provide text input. By submitting content, you grant CogniSensus a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content for the purpose of operating and promoting the App.

You represent and warrant that:

• You have the necessary rights to submit the content.
• Your content does not infringe the intellectual property or privacy rights of others.

CogniSensus is entitled at any time and without prior notice to remove any User-submitted content in case CogniSensus becomes aware or reasonably suspects that this content has violated these Terms.

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Circumvent, disable, or interfere with security features of the App.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity while using the App.

The App may include a leaderboard feature where you can compare your performance with other users. Points are awarded based on interactions with the App functionalities, AR content and quizzes. Points have no cash value and cannot be redeemed for money or goods.
Cognisensus reserves the right to modify, limit, or discontinue the leaderboard or points system at any time.

Upon termination for the reasons and in the events enumerated in these Terms, you must cease all use of the App and delete it from your device.

The App is provided “as is” without warranties of any kind, either express or implied. You use the App at your own risk.

In any case, you accept that the limit of CogniSensus liability (including costs) towards yourself for any reason whatsoever related to your use of the App is agreed to be the amount of one (1) Euro.

CogniSensus may update these Terms from time to time. Any changes will be effective immediately upon posting the revised Terms in the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

These Terms are governed by and construed in accordance with the laws of Greece, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Courts of Greece.
